Appeals of procurements which contain detected violations

Procurement monitoring for violations and timely response promotes the rational use of budget funds by customers.
The practice of appeals of procurements which contain violations has been introduced in 10 regions* of Ukraine. It was aimed at checking and researching the procurement, attracting attention of controlling institutions to procurement violations, making changes in tender documentation by the customers in order to remedy the discriminatory requirements.
For case implementation the cabinet on DoZorro portal was created, procurements with negative feedback were analyzed and letters to customers and to the controlling and law enforcement agencies in order to correct violations or bring the perpetrators to justice were sent.
During several months public monitors analyzed information on tenders with negative reviews in the regions. The unified methodology, which was developed by the experts of the Institute of analysis and advocacy, was used in the work.
Based on the results of the analysis and consultations with experts at different levels, monitoring specialists have developed an appeal for identified violations. They were sent to customers, controlling and law enforcement agencies. In these appeals, NGO representatives described the violations found, analyzed the regulatory framework, and recommended them to be corrected. The most frequent recommendation to law enforcement agencies is to make a purchase check.
As a result of such requests, the customers corrected the mistakes or re-advertised the tender procedure, which prevented the inefficient spending of budget funds.
Case implementers: NGO “Institute of analytics and advocacy” as the coordinator of public monitors work with CO “Network “100 per cent of life” in Rivne”, CO “Network “100 per cent of life” in Kharkiv”, CO “CO “Network” in Lviv “, NGO “Club” Chance“ in Sumy, CO “Chernihiv Network“, Kirovograd regional branch of “All-Ukrainian Network of PLWH“.
Result: An analysis of about 2000 tenders, written 445 appeals, 51 cases of changes which were made in order to correct violations or cases of bringing to justice those responsible for violations persons.
